Agordia understands how important the privacy of personal information is to our users. This Privacy Policy applies to websites owned and operated by Agordia that are intended for use by consumers (non-professionals) for non-commercial personal, family or household purposes, including agordia.com, agordia.me, and including the mobile optimized versions of these sites and our Mobile Device Applications (we refer to these sites and Apps collectively as the "Apps and Services"). BY ACCESSING OR USING THE APPS AND SERVICES, YOU AGREE TO THE PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY AND YOU HEREBY CONSENT TO THE COLLECTION, USE, AND SHARING OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU CANNOT USE THE APPS AND SERVICES. IF YOU USE THE APPS AND SERVICES ON BEHALF OF SOMEONE ELSE OR AN ENTITY (SUCH AS YOUR EMPLOYER), YOU REPRESENT THAT YOU ARE AUTHORIZED BY SUCH INDIVIDUAL OR ENTITY TO ACCEPT THIS PRIVACY POLICY ON SUCH INDIVIDUAL'S OR ENTITY'S BEHALF.

1. Introduction

Because BeaconMD Technology, LLC, d/b/a Agordia ("us," "we," or "Agordia") is committed to respecting the privacy rights of our users we created this Privacy Policy ("Privacy Policy") to give you confidence as you use the Apps and Services and to demonstrate our commitment to the protection of privacy. This Privacy Policy covers our practices with respect to personally identifiable information ("Personal Information") that we gather when you use our Apps and Services. This Privacy Policy does not apply to any other web service or digital service that you may be able to access through the Apps and Services or any web service or digital services of Agordia business partners, each of which have data collection, storage and use practices and policies that may differ from this Privacy Policy.

Remember that your use of the Apps and Services is at all times subject to the Terms (as the term "Agreement" is defined in our Terms of Conditions), which incorporates this Privacy Policy. Any capitalized term used but not defined in this Privacy Policy shall have the meaning in the Terms.

2. Information We Collect

Some of our Apps and Services may retain and store your personal information, accordance with this Privacy Policy. Even if you do not register with or provide any personal information to Agordia, we collect information about your use of the Apps and the Services. We may also acquire information about our users from external sources.

2.1 When you use the Services, we collect information as follows:

Services and Device Information

When you access and use our Apps and Services, Agordia automatically collects and stores in its server logs information from your browser or mobile device such as your IP address or unique device identifier, browser information (including referring URL), your preferences and settings, cookies and information about the content you have viewed and actions taken (e.g., search queries, ad engagement, clicks and the associated dates and times).

When You Contact Customer Support

Agordia may collect information through the app in order to, among other things, accurately categorize and respond to your inquiry and deliver appropriate service levels.

2.2 Billing, Collection and Payment Information

We may provide paid products and/or services within the Apps and Services. In that case, we use third-party services for payment processing (e.g. payment processors).

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

2.3 Information we automatically collect when you use our Apps and Services

We may employ third party companies and individuals to facilitate our Apps and Services ("Service Providers"), provide the Apps and Services on our behalf, perform Apps and Services-related services or assist us in analyzing how our Apps and Services are used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Analytics

We may use third-party Service Providers to monitor and analyze the use of our Apps and Services.

Firebase

Firebase is an analytics service provided by Google Inc.

You may opt-out of certain Firebase features through your mobile device settings, such as your device advertising settings or by following the instructions provided by Google in their Privacy Policy: https://policies.google.com/privacy?hl=en

Mixpanel

Mixpanel is provided by Mixpanel Inc.

4. Tracking Tools and Opt-Out Options

4.1. Tracking Tools

We may use tools outlined below in order to provide our Apps and Services to and to better understand users.

Cookies and Other Tracking Technologies: We use cookies to collect information about your use of the Apps and Services. "Cookies" are small data files assigned to your browser when you visit Agordia.com and Agordia.me Sites which enable recognition of your browser and collect and store information about your use of the Services, as described above. In addition to cookies, we use other tracking technologies that collect information about your use of the Apps and Services, including mobile identifiers and "web beacons" which are small graphic files (sometimes called "clear GIFs" or "web pixels") embedded in a web page or email typically used to monitor activity and send relevant information back to a home server (which can belong to the host site, a network advertiser or some other third party).

Web Service Analytics: We may use third-party analytics services in connection with the Apps and Services, including, for example, to register mouse clicks, mouse movements, scrolling activity and text typed into the Site. We use the information collected from these services to help make the Apps and Services easier to use and as otherwise set forth in Section 5 (How We Use Your Information). These analytics services generally do not collect Personal Information unless you voluntarily provide it and generally do not track your browsing habits across web services that do not use their services.

Mobile Device Identifiers: As with other Tracking Tools, mobile device identifiers help Agordia to learn more about our users' demographics and internet behaviors in order to personalize and improve the Apps and Services. Mobile device identifiers are data stored on mobile devices that may track mobile device and data and activities occurring on and through it, as well as the applications installed on it. Mobile device identifiers enable the collection of Personal Information (such as media access control, address and location) and Traffic Data.

4.2 Interest-Based Advertising

We may use a type of advertising commonly known as interest-based or online behavioral advertising. This means that some of our partners use Tracking Tools, such as cookies, pixel tags, and web beacons, to collect information about a user's online activities to display Agordia ads to the user based on the user's interests ("Behavioral Advertising"). Such partners may include third-party service providers, advertisers, advertising networks or platforms, traffic measurement service providers, marketing analytics service providers, and other third-party service providers (collectively, "Advertising Service Providers"). Other Tracking Tools used by our partners may collect information when you use the Services, such as IP address, mobile device ID, operating system, browser, web page interactions, geographic location and demographic information, such as gender and age range. These Tracking Tools help Agordia learn more about our users' demographics and internet behaviors

4.3 Options for Opting out of Cookies and Mobile Device Identifiers

Some web browsers allow you to reject cookies or to alert you when a Cookie is placed on your computer, tablet or mobile device. You may be able to reject mobile device identifiers by activating the appropriate setting on your mobile device. Although you are not required to accept Agordia's cookies or mobile device identifiers, if you block or reject them, you may not have access to all features available through the Apps and Services.

You may opt out of receiving certain trackers by visiting the Network Advertising Initiative (NAI) opt-out page or the Digital Advertising Alliance (DAA) consumer opt-out page, or by installing the DAA's AppChoice app for iOS on your mobile computing device. When you use these opt-out features, an "opt-out" Cookie will be placed on your mobile computing device indicating that you do not want to receive interest-based advertising from NAI or DAA member companies. You will need to opt out of each device for which you desire to apply these opt-out features.

This Privacy Policy does not cover the use of cookies and other Tracking Tools by any third parties, and we aren't responsible for their privacy policies and practices. Please be aware that some cookies placed by third parties can continue to track your activities online even after you have left our Apps and Services.

5. How We Use Your Information

Information about your use of the Services may be used for the following purposes:

To help improve the Apps and Services and to develop new services;

Providing you with the products, services and information you request;

Responding to correspondence that we receive from you;

Contacting you when necessary or requested;

Providing, maintaining, administering or expanding the Apps and Services, performing business analyses, or for other internal purposes to support, improve or enhance our business, the Apps and Services and other products and services we offer;

Customizing or tailoring your experience of the Apps and Services, which may include sending customized messages;

Notifying you about certain resources, services we think you may be interested in learning more about;

Sending you information about Agordia or our products or Apps and Services;

Sending emails and other communications that display content that we think will interest you and according to your preferences;

Combining information received from third parties with information that we have from or about you and using the combined information for any of the purposes described in this Privacy Policy;

Using statistical information that we collect in any way permitted by law;

Fulfilling our legally required obligations, such as preventing, detecting and investigating security incidents and potentially illegal or prohibited activities;

Resolving disputes;

Protecting against or deterring fraudulent, illegal, or harmful actions; and

Enforcing our Terms and Conditions and other agreements.

6. How We Share Your Information

In certain circumstances, and in order to perform the Apps and Services, we may share certain information that we collect from you, as described in this section:

We may share your Personal Information and/or Traffic Data with our partners who perform operational services (such as hosting, billing, fulfillment, data storage, security or web service analytics) and/or who make certain services, features or functionality available to our users.

Business Transfers: We may transfer your Personal Information to another company in connection with a proposed merger, sale, acquisition or other change of ownership or control by or of Agordia (whether in whole or in part). Should one of these events occur, we will make reasonable efforts to notify you before your information becomes subject to different privacy and security policies and practices.

Protection of Agordia and Others: We also may need to disclose your Personal Information or any other information we collect about you if we determine in good faith that such disclosure is needed to: (1) comply with or fulfill our obligations under applicable law, regulation, court order or other legal process; (2) protect the rights, property or safety of you, Agordia or another party; (3) enforce the Agreement or other agreements with you; or (4) respond to claims that any posting or other content violates third-party rights.

7. Storage and Security of Information

The security of your Personal Information is important to us. We endeavor to follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and in storage.

Agordia currently uses several "Service Providers" for its storage, communications, security and cloud computing needs. We believe that these Service Providers are trustworthy and who have confirmed that their privacy practices are consistent with ours. We provide our Service Providers with only the information necessary for them to perform these services. Each Service Provider must agree to use reasonable security procedures and practices, appropriate to the nature of the information involved, in order to protect your Personal Information from unauthorized access, use or disclosure. Service Providers are prohibited from using Personal Information in any manner other than as specified by us. Agordia shall endeavor to implement reasonable security measures in connection with the Apps and Services; however, Customer acknowledges, that no data transmission over the Internet or data storage system can be guaranteed to be 100% secure and Agordia cannot guarantee the security of data transmitted to it or that it stores. Agordia shall not be liable to Customer for any liabilities arising from the operation of the Apps and Services over the Internet or other networks outside of its control.

If you have registered: Your account is protected by a password for your privacy and security. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password and/or other sign-on mechanisms appropriately and limiting access to your device by signing off after you have finished accessing your account.

Although we make good faith efforts to store Personal Information in a secure operating environment that is not open to the public, we do not and cannot guarantee the security of your Personal Information. If at any time during or after our relationship we believe that the security of your Personal Information may have been compromised, we may seek to notify you of that development. If a notification is appropriate, we will endeavor to notify you as promptly as possible under the circumstances. If we have your e-mail address, we may notify you by e-mail to the most recent e-mail address you have provided us in your account profile. Please keep your e-mail address in your account up to date. You can update that e-mail address anytime in your account profile. If you receive a notice from us, you can print it to retain a copy of it. To receive these notices, you must check your e-mail account using your computer or mobile device and email application software. You consent to our use of e-mail as a means of such notification. If you prefer for us to use the U.S. Postal Service to notify you in this situation, please e-mail us at support@agordia.com. Please include your address when you submit your request. You can make this election any time, and it will apply to notifications we make after a reasonable time thereafter for us to process your request. You may also use this e-mail address to request a print copy, at no charge, of an electronic notice we have sent to you regarding a compromise of your Personal Information.

8. Your Choices

If you are a registered user of the Apps and Services, you can modify certain Personal Information or account information by logging in and accessing your account. The information you can view, update, and delete may change as the Apps and Services change.

If you have registered and desire to delete any of your registration information you have provided to us from our Apps and Services, please contact us at support@agordia.com. Agordia will use reasonable efforts to promptly delete any Personally Identifiable Information, that is not available in the Public Domain, of your account. Please note, however, that Agordia reserves the right to retain information from closed accounts, including to comply with the law, prevent fraud, resolve disputes, enforce the Agreement and take other actions permitted by law.

You must promptly notify us if any of your account data is lost, stolen or used without permission.

9. How Long We Retain Your Information

We retain Personal Information about you for as long as you have an open account with us or as otherwise necessary to provide you Apps and Services. In some cases, we retain Personal Information for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, prevent fraud, enforce the Agreement, or as otherwise permitted or required by applicable law, rule or regulation. Afterward, we retain some information in a depersonalized or aggregated form but not in a way that would identify you personally.

10. Information Provided on Behalf of Children and Others

As noted in the Terms and Conditions, the Apps and Services are not intended for use by children and children under the age of 13 are prohibited from using the Apps and Services. Agordia does not knowingly collect any information from children, nor are the Apps and Services directed to children. If you are under 13, please do not attempt to register for the Apps and Services or send any Personal Information about yourself to us.

By accessing, using and/or submitting information to or through the Apps and Services, you represent that you are not younger than age 13. If we learn that we have received any information directly from a child under age 13 without his/her parent's written consent, we will use that information only to respond directly to that child (or his/her parent or legal guardian) to inform the child that he/she cannot use the Apps and Services, and we will subsequently delete that information. If you believe that a child under 13 may have provided us Personal Information, please contact us at support@agordia.com.

If you use the Apps and Services on behalf of another person, regardless of age, you agree that Agordia may contact you for any communication made in connection with providing the Apps and Services or any legally required communications. You further agree to forward or share any such communication with any person for whom you are using the Apps and Services on behalf.

11. Updates and Changes to Privacy Policy

The effective date of this Privacy Policy is set forth at the top of this page. We will notify you of any material change by posting a notice in our Apps and Services. Your continued use of the Apps and Services after the effective date constitutes your acceptance of the amended Privacy Policy. We encourage you to periodically review this page for the latest information on our privacy practices. Any amended Privacy Policy supersedes all previous versions. IF YOU DO NOT AGREE TO FUTURE CHANGES TO THIS PRIVACY POLICY, YOU MUST STOP USING THE APPS AND SERVICES AFTER THE EFFECTIVE DATE OF SUCH CHANGES.
